Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Lumen Bloom LLC (“Lumen Bloom,” “we,” “us”) and govern your use of the Lumen Bloom mobile app, the Lumen Bloom Grip Meter when used with the app, and related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or legal guardian who agrees to these Terms.

2. Your account

You can sign in with an email and password, with Apple, or with Google. You are responsible for keeping your sign-in credentials secure and for all activity on your account. Give us accurate information and keep it up to date. Tell us right away at support@lumenbloom.io if you believe your account has been used without your permission.

3. Health and safety

The Service provides grip-strength measurements, training games, goals, and reminders for general fitness purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Talk to a doctor before starting any exercise program, especially if you have an injury or a medical condition. Stop using the Service and seek medical help if you feel pain, dizziness, or discomfort. You use the Service at your own risk.

4. The Grip Meter and the app

Some features require a Lumen Bloom Grip Meter connected over Bluetooth. Measurements depend on the device, its calibration, battery level, and how it is used, and may not be perfectly accurate. We may update the app and the Grip Meter’s firmware to fix problems, add features, or improve performance.

5. Lumen Bloom Pro subscriptions and free trials

  • Lumen Bloom Pro is an optional auto-renewing subscription that unlocks Pro games. Prices and billing periods (monthly or yearly) are shown in the app before you buy.

  • Purchases are processed by the app store you use (Google Play or the Apple App Store) and are charged to your store account. The store’s terms also apply to your purchase.

  • Your subscription renews automatically at the end of each period at the then-current price unless you cancel at least 24 hours before the period ends. You can manage or cancel your subscription at any time in your Google Play or App Store account settings. Deleting the app or your Lumen Bloom account does not cancel your subscription.

  • If a free trial is offered, it is available to eligible new subscribers only. Unless you cancel at least 24 hours before the trial ends, the trial converts to a paid subscription and you will be charged.

  • Refunds are handled by Google Play or Apple under their refund policies. We cannot issue refunds for store purchases directly.

  • If we change subscription prices, the app store will notify you as its rules require, and you can cancel before the new price applies.

6. License and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial use, subject to these Terms. You agree not to: copy, modify, or reverse engineer the app except where the law allows; interfere with or disrupt the Service or its security; access the Service by automated means; cheat, manipulate scores, or falsify measurements on leaderboards; impersonate anyone; or use the Service for anything unlawful.

7. Usernames and leaderboards

Your username and scores may be visible to other users on leaderboards. Do not choose a username that is offensive, misleading, or infringes someone else’s rights. We may change or remove usernames and scores that break these Terms.

8. Privacy

Our Privacy Policy at https://lumenbloom.io/privacy-policy explains how we collect and use your information.

9. Deleting your account

You can delete your account at any time in the app (Settings → Delete Account) or by following the instructions at https://lumenbloom.io/delete-account.

10. Termination

You may stop using the Service at any time. We may suspend or end your access if you break these Terms or if we must do so for legal reasons. Sections 3 and 11 through 14 continue to apply after your access ends.

11. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that measurements will be accurate.

12. Limitation of liability

To the fullest extent the law allows, Lumen Bloom LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim or US $50. Some jurisdictions do not allow these limitations, so they may not apply to you.

13. Indemnification

You agree to defend and indemnify Lumen Bloom LLC against claims, damages, and costs, including reasonable attorneys’ fees, arising from your misuse of the Service or your violation of these Terms.

14. Governing law

These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Michigan, and you consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and tell you in the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
